Deportation, Entry Bans and Detention in Türkiye: Urgent Guide

5 min read Enes Nergiz Law Office

Urgent point: A deportation decision, entry ban and administrative detention order are separate legal acts. Obtain the complete written decisions and proof of notification immediately. Do not rely only on an immigration code, verbal statement or screenshot, because the available remedy and deadline depend on the exact act.

Documents to secure immediately

  • Every page of the deportation, entry-ban or administrative-detention decision.
  • Signature, service form or other proof showing when and how notification occurred.
  • Passport identity page and all relevant entry, exit, visa and permit pages.
  • Residence-permit applications, cards, refusals and cancellation records.
  • Any criminal investigation, prosecution, acquittal or conviction document connected with the decision.
  • Health, family, child, protection or country-risk evidence that may be relevant.
  • Power-of-attorney and interpreter records already used.
  • A chronology stating current location, custody status and all known deadlines.

Deportation decision

A deportation decision concerns removal from Türkiye under the Law on Foreigners and International Protection. The legal review should identify the stated statutory ground, underlying evidence, individual assessment and any circumstances that may prevent removal. The written reasons should be compared with the immigration and, where relevant, criminal file.

Judicial review may be available, but the procedure and effect of an application must be checked under the law in force and the person’s exact circumstances. Deadlines should be calculated from verified notification, not from when a family member later heard about the decision.

Entry restriction

An entry ban concerns future admission to Türkiye. It may accompany removal or arise separately. The code shown in a system is not always a complete explanation of the legal basis, duration or authority. Passport history, previous removals, visa or residence violations, public-order allegations and any connected proceedings should be examined.

The appropriate route may involve an administrative request, judicial action or coordination with a Turkish consulate, depending on the act. A new visa application does not automatically cancel an existing restriction.

Administrative detention

Administrative detention concerns custody pending immigration action and is distinct from criminal arrest or imprisonment. The detention decision, periodic review, conditions, current removal-centre location and access to counsel or communication should be established. Urgency is especially high where liberty and imminent removal are involved.

Challenges to detention and challenges to deportation may proceed through different judicial channels. Filing one should not be assumed to replace the other. Each decision and deadline needs its own procedural plan.

Evidence requiring individual assessment

Family unity, the best interests of a child, health, risk of persecution or ill-treatment, international protection history and other non-refoulement considerations may be relevant. General statements are rarely enough. Obtain civil-status records, medical reports, residence evidence, school records, prior protection decisions and reliable country or personal-risk material where appropriate.

Criminal files and immigration consequences

An investigation, arrest, acquittal, conviction or foreign notice can affect the factual background, but immigration authorities and courts must be addressed through the correct legal framework. The complete criminal documents should be obtained. A translated news report or informal database printout should not replace the official record.

What not to do

  • Do not sign a document you do not understand without requesting interpretation.
  • Do not assume that release from criminal custody cancels an immigration measure.
  • Do not wait for the removal centre or authority to explain every legal deadline.
  • Do not submit inconsistent accounts in different applications.
  • Do not send original evidence without keeping complete copies and delivery proof.
  • Do not publish sensitive allegations or personal data while the case is pending.

Working with a lawyer from Alanya

A family member or the foreign national can normally begin by sending the decisions and chronology securely. Representation may require a power of attorney, while urgent access and document collection depend on the person’s location and the competent authority. Enes Nergiz Law Office is physically based only in Alanya and handles selected Turkish-law immigration matters in other locations without presenting branch offices.

Frequently asked questions

Is an immigration restriction code the same as a written decision?

No. A code may indicate an administrative record, but the written act, reasons, authority and notification must be obtained where possible.

Does an appeal against deportation end detention?

Not automatically. Deportation and administrative detention are distinct measures and may require separate challenges.

Can relatives instruct a lawyer?

They can provide documents and seek an initial assessment, but formal representation, access and applications depend on authority, confidentiality and procedural requirements.

Can success be guaranteed in an urgent case?

No. The outcome depends on the facts, evidence, statutory grounds and judicial or administrative assessment. Urgent legal work can protect deadlines and present the case but cannot guarantee a result.

5. 2026 Restriction Codes (G-87, V-69, Ç-113) & Constitutional Court Injunctions

In 2026 administrative court practice across Antalya and Ankara, challenging a deportation order also requires addressing the underlying restriction code (Tahdit Kodu) recorded by the Directorate General of Migration Management:

  • Separate Annulment of Restriction Codes: Even after a foreigner departs Türkiye voluntarily or after a detention order is lifted, administrative codes such as G-87 (general security allegation), V-69 (cancelled residence permit), or Ç-113 / Ç-114 remain active unless challenged within 60 days before the competent Administrative Court or overcome via an annotated visa (Meşruhatlı Vize).
  • Constitutional Court Urgent Measure (AYM Tedbir): Where a deportation order cites Article 54/1-b, d, or k of Law No. 6458, the 7-day Administrative Court lawsuit must be accompanied where appropriate by an urgent individual application to the Constitutional Court of Türkiye to prevent removal where fundamental family or life/integrity rights are at risk.
