Administrative & Public Law in Türkiye

Short answer: Administrative and public-law disputes in Alanya concern decisions or omissions of public authorities. Effective review starts with the complete written act, legal basis, evidence, authority, notification and applicable time limit. An informal explanation is not a substitute for the official file.

Administrative-law services

  • Judicial review of administrative decisions and sanctions.
  • Licence, permit, closure and regulatory disputes.
  • Public employment and disciplinary matters.
  • Property, zoning, municipal and expropriation-related administrative issues.
  • Immigration, residence and citizenship-related administrative litigation.
  • Claims connected with unlawful administrative action where legally available.
  • Urgent stay-of-execution and interim-protection analysis.

Legality of an administrative decision

Review may concern competence, form, stated reasons, subject matter, purpose, proportionality and compliance with procedure. The factual evidence relied upon by the authority should be compared with the decision. A court does not simply replace administrative discretion; the legal defect and requested remedy must be framed correctly.

Notification and deadlines

Administrative remedies often depend on strict procedural periods. The decision date, notification date, method of service and any prior administrative application must be documented. Waiting for further informal correspondence may not suspend a period. The exact current statute must be checked before calculating any deadline.

Stay of execution

A request to suspend implementation is not automatically granted by filing a case. The statutory conditions and evidence of illegality and serious or irreparable consequence must be addressed. The requested protection should be proportionate and connected with the challenged act.

Evidence and administrative file

The applicant should preserve the decision, service record, inspection report, defence or petition previously submitted, photographs, permits, correspondence and supporting technical or financial records. Where the authority relied on an incomplete or incorrect fact, the contrary evidence should be identified precisely.

Documents for review

  • Complete administrative decision and annexes.
  • Proof of notification or service.
  • Inspection, investigation or disciplinary reports.
  • Earlier petitions, defence submissions and official responses.
  • Licence, permit, property, employment or immigration records.
  • Chronology, current impact and known deadline.

Frequently asked questions

Can every administrative act be challenged?

The reviewability, standing, finality and procedure depend on the particular act.

Does filing automatically stop the decision?

No. Suspension requires a separate legal assessment and court decision where available.

Can I wait for the authority to reconsider?

Do not assume correspondence suspends litigation periods. Deadlines must be checked immediately.

Can damages also be claimed?

Possibly, under the applicable conditions and procedure. Causation and proof of loss are required.
